Furthermore, on being a motion looking for the declaration of certainty of a situation -the infringement or threat of the right plus the imposition a benefit -arder tending to the threat or the infringement to cease-, I consider that the tutela may be classified without any difficulty as a declarative pretension of sentence.os elementos estructurales propios de la tutela -reclamación elevada por cualquier persona ante un juez y frente a cualquiera autoridad pública o particulares cualificados, para la protección de los derechos fundamentales- presentan una verdadera relación de concordancia con la definición estructural de pretensión procesal, entendida como una reclamación elevada por un sujeto activo ante un juez y frente a un sujeto pasivo por un bien específico de la vida.
