Based on the question "How has the right of access to environmental information been exercised in Colombia since the Political Constitution of 1991? the article's general objective is to understand the conditions under which the right of access to environmental information has been exercised since the Political Charter, but it first assumes the commitment to propose a legal conceptualization of environmental information that contributes to define security paths that facilitate the exercise of the right of access. For this purpose, a qualitative methodology was used, including hermeneutic and phenomenological methods, and the semi-structured in-depth interview as a technique of information gathering, which followed a deductive line that started by investigating the valuation of the exercise of the right of access to information in general, then on the exercise of that right of access in environmental matters, and finally, on the exercise of the right of access to environmental information when it is necessary to access justice. This made it possible to reveal the material interdependence between the rights of access in environmental matters, as well as the imperative need to exhaust the judicial process in order to obtain access and see the information guaranteed, which is then necessary to be able to take further legal action. |
