It was developed from the quantitative approach with a descriptive methodology with a non-experimental design, which was supported by the documentary-bibliographic analysis. It consisted of the review of existing bibliographic material regarding the subject to be studied. By stating that there is a lack of political will to eradicate the crime of embezzlement, it is true that agencies have been created to combat corruption, the results have not been entirely encouraging, perhaps the product of political affiliations.La investigación busca analizar el delito de peculado y la relación que tiene con los servidores públicos y sus familiares, donde se ha evidenciado que el mismo, ha proliferado en todas las esferas del gobierno, en medio de un estado de excepción afectando así, la buena administración pública. Se desarrolló desde el enfoque cuantitativo con una metodología descriptiva con diseño no experimental, la cual se apoyó en el análisis documental–bibliográfico. Consistió en la revisión de material bibliográfico existente con respecto al tema a estudiar.
