Sumario: The objective of the investigation was to describe the importance of the conditional suspension of the procedure in customs crimes and its relation to the principles of opportunity and minimal criminal intervention in Ecuador. It was elaborated from the descriptive type with non-experimental field design, applying a survey, the survey form was applied to a population of thirty professionals of the Law specialized in Criminal Sciences, all of them related to the Judicial District of Loja. Customs Law has as its own essence a set of legal norms that regulate the origin, collection and purposes of the tax in border areas. There is a need to propose changes in the customs criminal regime to guarantee the rights of the parties, as the accused accepts the conditional suspension of the procedure, prior to guaranteeing due process.
