It is based on a quantitative, documentary-bibliographic perspective. This in view of the fact that from the documentary review and the study of the social reality observed, reflective conclusions have been inferred by the researcher, of the problematic raised. In this sense, the current regulations, theses, international agreements and refereed works related to the subject under study were analyzed. It is concluded that, it was evidenced that there is currently a certain violation towards indigenous peoples and nationalities when it comes to guaranteeing their innate or constitutionally established rights. This aspect marks a significant gap since the State, through the Constitution of the Republic of Ecuador, must guarantee the free ideology and promote the cultural recognition of indigenous peoples.En la presente investigación se planteó como objetivo general analizar jurídicamente la evolución histórica y social de los derechos de pueblos y nacionalidades indígenas en Ecuador. Se apoya en la perspectiva cuantitativa, de tipo documental-bibliográfica. Esto en vista de que a partir de la revisión documental y el estudio de la realidad social observada se han logrado inferir conclusiones reflexivas por parte del investigador, de la problemática planteada. En este sentido se analizó la normativa vigente, tesis, acuerdos internacionales y trabajos arbitrados relacionados al tema en estudio. Se concluye que, se evidenció que en la actualidad existe cierta vulneración hacia los pueblos y nacionalidades indígenas a la hora de garantizar sus derechos innatos o constitucionalmente establecidos.
