Through a bibliographic design of documentary type, which sought reflection and critical analysis, building related methods of discernment of the phenomenon and thus evaluate or consider new contexts. The knowledge and expertise that contributed to the work was obtained from legal documents, norms and agreements, extracting relevant information, the necessary analyses were carried out contributing to the obtaining of information. It is concluded that the importance of psychologists must be taken into account and the lack of concern that each psychologist has to attend at least 201 persons deprived of liberty and for this reason a correct diagnosis is not carried out because a psychologist cannot work efficientlyEn la presente investigación se planteó como objetivo general analizar jurídicamente la crisis carcelaria en Ecuador. El camino investigativo se recorrió bajo el enfoque cuantitativo, mediante la indagación, recolección y análisis crítico a través de una tipología documental, bibliográfica y estadística. Mediante un diseño bibliográfico de tipo documental, que buscó la reflexión y analizar críticamente, construyendo métodos relacionados de discernimiento del fenómeno y así evaluar o considerar nuevos contextos. El conocimiento y experticia que contribuyeron al trabajo se obtuvo de documentos legales, normas y convenios, extrayendo información relevante, se realizaron los análisis necesarios contribuyendo a la obtención de información.
