The bibliographic-documentary design was supported by logical and mental processes. The researchers organized a research process where the study population was based primarily on written documents, norms, laws, to investigate the writings in order to study them and build conclusions that favor the generation of new knowledge. It is concluded that medical negligence is that action or omission of the person who, knowing his objective duty of care, acts irresponsibly in the course of emergency care in this case. Thus, the national worldview regarding pre-hospital care in traffic accidents.En la presente investigación se planteó como objetivo general analizar jurídicamente la negligencia médica en la atención de accidentes de tránsito, Ibarra, Ecuador. Desde el paradigma cuantitativo, se maneja para este tipo de estudio, documentos, textos legales, investigaciones científicas mediante la recolección, selección y análisis de los mismo. El diseño bibliográfico-documental se apoyó en los procesos lógicos y mentales. Los investigadores organizaron un proceso investigativo en donde la población de estudio, se basó primordialmente en documentos escritos, normas, leyes, para indagar los escritos con el objeto de estudiarlos y construir conclusiones que favorecen en la generación de nuevos conocimientos. Se concluye que, la negligencia médica es aquella acción u omisión de la persona que conociendo su deber objetivo de cuidado actúa de forma irresponsable en el curso de atención de emergencias en este caso.
