The guarantee of the democratic State of rights, has as an essential function, among others, the protection of fundamental rights, which are continuously violated when the States Parties to the American Convention on Human Rights fail to comply with their international obligations, hence the lack of execution of the judgments issued by the Inter-American Court of Human Rights (IA Court) against the States Parties, has become the Achilles' heel of the American Convention on Human Rights, because it affects democracy and a lack of justice for the victims. From this point of view, it is intended to analyze how the presentation of the Annual Report of the Inter-American Court to the General Assembly of the OAS can be a mechanism for strengthening democracy deliberative and for claiming the rights of victims.

From this point of view, it is intended to analyze how the presentation of the Annual Report of the Inter-American Court to the General Assembly of the OAS can be a mechanism for strengthening democracy deliberative and for claiming the rights of victims.A garantia do Estado Democrático de Direitos tem como função essencial, entre outras, a proteção dos direitos fundamentais, que são continuamente violados quando os Estados Partes da Convenção Americana sobre Direitos Humanos não cumprem suas obrigações internacionais, daí a falta de execução das sentenças emitidas pela Corte Interamericana de Direitos Humanos (Corte AI) contra os Estados Partes, tornou-se o calcanhar de Aquiles da Convenção Americana sobre Direitos Humanos, porque afeta a democracia e a falta de justiça para as vítimas. A partir deste ponto de vista, pretende-se analisar como a apresentação do Relatório Anual da Corte Interamericana à Assembléia Geral da OEA pode ser um mecanismo de fortalecimento da democracia e de reivindicação dos direitos das vítimas.La garantía del Estado democrático de derechos, tiene como función esencial, entre otros, la protección de los derechos fundamentales, los cuales se vulneran continuamente cuando los Estados Parte de la Convención Americana de Derechos Humanos, incumplen sus obligaciones internacionales, de allí que la falta de ejecución de las sentencias emitidas por la Corte Interamericana de Derechos Humanos (Corte IDH) contra los Estados Parte, se ha convertido en el talón de Aquiles de la Convención Americana de Derechos Humanos, porque se da una afectación a la democracia y una falta de justicia para las víctimas.
