In 1991, Colombia transformed its State model with the adoption of a new Constitution, this allowed the different branches of Law to be subject to the axiological parameters proposed under the Social State of Law, since article 4 of the charter Magna points out that no norm of the legal system can be contrary to it. The constitutionalization brought as a consequence an interpretation of the norms adjusted to these postulates, principles and values. Given this scenario, civil, criminal, and commercial law, among others, have been developed under the influence of constitutional postulates. Regarding Customs Law, its development has been marked by the influence of tax law, an aspect that raised different positions by writers when determining the autonomy of Customs Law compared to other specialties, however, customs regulation and its development must be adjusted to the structure that supports and guides the Social State of Law and those international provisions that seek the harmonization of customs processes and procedures, whose purpose is to benefit and promote international trade.

A constitucionalização trouxe como consequência uma interpretação das normas ajustadas a esses postulados, princípios e valores. Diante desse cenário, o direito civil, penal, comercial, entre outros, tem se desenvolvido sob a influência de postulados constitucionais. No que se refere ao Direito Aduaneiro, seu desenvolvimento tem sido marcado pela influência do direito tributário, aspecto que suscitou diferentes posicionamentos dos escritores ao determinar a autonomia do Direito Aduaneiro em relação às demais especialidades, entretanto, a regulamentação aduaneira e seu desenvolvimento devem ser ajustados às estrutura que fundamenta e orienta o Estado Social de Direito e as disposições internacionais que buscam a harmonização dos processos e procedimentos aduaneiros, cuja finalidade é beneficiar e promover o comércio internacional.En el año 1991, Colombia transformó su modelo de Estado con la adopción de una nueva Constitución, esto permitió que las diferentes ramas del Derecho debieran sujetarse a los parámetros axiológicos propuestos bajo el Estado Social de Derecho, toda vez que el artículo 4 de la carta magna señala que ninguna norma del ordenamiento jurídico puede estar en contravía con la misma. La constitucionalización trajo como consecuencia una interpretación de las normas ajustada a estos postulados, principios y valores. Ante este panorama, el derecho civil, penal, comercial entre otros se han desarrollado bajo la influencia de los postulados constitucionales.
