Summary: The purpose of this article is to analyze in what way the assumption of the risk configures an exoneration of civil liability for damages caused in septoplasty procedures; therefore, the work is carried out by means of a descriptive legal research. Taking into account that nasal septum deviation is the most frequent pathology, and can be corrected by means of septoplasty with Cottle's technique; as any procedure presents risks, which, when voluntarily accepted by the patient prior to the septoplasty procedure, would configure the assumption of risk as an exemption of liability.
