Supported by a documentary-bibliographic study, which includes the national legislation applicable to the subject, books and relevant articles and documents of the Ecuadorian justice administration agencies such as the State Attorney General's Office in its role as director of the preprocedural and procedural criminal investigation, critically analyzing these sources and describing the findings found, allowing the development of the theoretical body. in relation to the subject of study. It is concluded that, in the Ecuadorian criminal process, the principle of evidentiary freedom governs, based on which the procedural subjects may request the judge to incorporate to the process any means of proof of guilt or innocence.En la presente investigación, se planteó como objetivo general analizar jurídicamente el consentimiento para la extracción de un fluido corporal en un proceso penal. Se desarrolló la metodología cuantitativa la cual produce datos descriptivos, que se originan por la recolección de datos, de fuente documental-bibliográfica. Apoyado en un estudio documental-bibliográfico, que incluye la legislación nacional aplicable al tema, libros y artículos relevantes y documentos de los organismos de la administración de justicia ecuatoriana como es la Fiscalía General del Estado en su función directora de la investigación penal preprocesal y procesal, analizando críticamente dichas fuentes y describiendo los hallazgos encontrados, permitiendo desarrollar el cuerpo teórico. en relación al tema de estudio.
