A type of documentary research. The crime of physical violence cannot be considered a minor crime, a mere contravention, but on the contrary and because of the consequences of this crime on the victim and the infringements of constitutional rights as important as the right to personal integrity, freedom, protection of the family and in the worst case the right to life, it is to be considered gradually as a crime of medium to high gravity according to the factual circumstances in particular, therefore the penalty should be severe and broad in its limits. For these reasons, it is necessary a legislative reform to solve this problem and ensure no impunity and justice.Se tiene por objetivo analizar la tipificación del delito de violencia física intrafamiliar en la legislación ecuatoriana. Un tipo de investigación documental. El delito de violencia física no puede considerarse de un delito leve, de mera contravención, sino por el contrario y a razón de las consecuencias de este delito en la víctima y a las infracciones de derechos constitucionales tan importante como el derecho a la integridad personal, a la libertad, a la protección de la familia y en el peor de los casos el derecho a la vida, es de considerar gradualmente como un delito de mediana a alta gravedad conforme a las circunstancias fácticas en concreto, por ende la pena debe ser grave y amplía en sus límite.
