Tradicionalmente el Derecho Tributario se ha hecho cargo de los efectos fiscales las transacciones comerciales locales, y más adelante enel tiempo,de los efectos fiscales de las transacciones transnacionales.La necesidad de generar un sistema más justo de reparto de los ingresos tributarios entre las jurisdicciones tributarias, derivados de las transacciones con elementos internacionales, han significado una serie de esfuerzos de los países, para generar instrumentos bilaterales o multilaterales. La labor de la OCDE ha sido muy relevante en este campo, lo que se ha coronado con los BEPS. Esta perspectiva ha dejado de lado un campo muy relevante de los sistemas tributarios en una perspectiva nacional y global, el de los derechos humanos,lo que muchos expertos han puesto de relieve crecientemente en los últimos años. Los derechos humanos impactan todo el sistema tributario, desde sus fundamentos su gestión y sus resultados. Tanto económicos, institucionales y sociales. El presente trabajo intenta mostrar de un modo sistemático el trabajo de los expertos en este campo en el último tiempo.

La necessitat de generar un sistema més just de repartiment dels ingressos tributaris entre les jurisdiccions tributàries, derivats de les transaccions amb elements internacionals, han significat una sèrie d'esforços dels països, per a generar instruments bilaterals o multilaterals. La labor de l'OCDE ha estat molt rellevant en aquest camp, la qual cosa s'ha coronat amb els BEPS. Aquesta perspectiva ha deixat de costat un camp molt rellevant dels sistemes tributaris en una perspectiva nacional i global, el dels drets humans, la qual cosa molts experts han posat en relleu cada cop més en els últims anys. Els drets humans impacten tot el sistema tributari, des dels seus fonaments la seva gestió i els seus resultats. Tant econòmics, institucionals i socials. El present treball intenta mostrar d'una manera sistemàtica el treball dels experts en aquest camp en l'últim temps.Traditionally, Tax Law has addressed the tax effects of local commercial transactions, and later in time, the tax effects of transnational transactions. The need to generate a fairer system for the distribution of tax revenues between tax jurisdictions, derived from transactions with international elements, has meant a series of efforts by countries to stablishbilateral or multilateral instruments. The work of the OECD has been very relevant in this field, which has been crowned with the BEPS. This perspective has neglected a very relevant field of tax systems from a national and global perspective, the role and effects of human rights, which many tax experts have increasingly highlighted in recent years. Human rights impact the entire tax system, from its foundations, its management and its results, be the same economic, institutional and social.
