Bilateral and regional cooperation has become the prime instrument for regulating world trade in the 21st century, as opposed to the multilateral forum of the World Trade Organisations (WTO) and the increasingly prominent protectionist attitudes of major economic powers. Considering the above, this contribution aims to facilitate the understanding of the new generation trade and investment agreements in the overall context of EU trade policy. We will start with an outline of the concept of new generation agreements and continue with an analysis of their regulatory heterogeneity, where we provide some considerations regarding EU’s competence in the areas concerned. The study will conclude with a revision of the growing predominance of competitiveness, reciprocity, and differentiation, as both the drivers and inspiration in the restructuring of the EU’s trade agenda, to further stress the relevance of transparency and democracy principles for the governance of the EU’s external action.

La présente contribution porte sur l’étude du phénomène des accords de nouvelle génération, en tant qu’instrument au service de la politique commerciale contemporaine de l’UE. Celle- ci débute par un aperçu de la notion d’accords de nouvelle génération, puis se poursuit par une présentation de leur structure typique et de leur contenu normatif. L’étude se termine par une révision des principes régissant la conclusion d’accords de nouvelle génération à tous les stades, les intérêts de compétitivité et de sécurité stratégique, les principes de réciprocité et de différenciation qui conditionnent le contenu réglementaire d’un accord spécifique, ainsi que exigences de transparence et de démocratisation qui ont – au cours des années récentes – modifié le processus formel de conclusion d’accords commerciaux au sein de l’UE.La cooperación bilateral y regional se ha convertido en el instrumento predilecto para la regulación del comercio mundial del siglo xxi, en contraposición al foro multilateral de la Organización Mundial del Comercio (en adelante, OMC) y a las actitudes proteccionistas, cada vez más notorias, de grandes potencias económicas. A la vista de este cambio de paradigma, la presente contribución pretende ofrecer una visión de conjunto de los acuerdos de nueva generación en el contexto global de la política comercial de la Unión Europea (en lo sucesivo, UE).
