Sumario: The new jurisprudence of the Spanish Constitutional Court on the proxy vote in the Autonomous Legislative Assemblies that arose due to its use in the Parliament of Catalonia implies the need to review the regulation in all those regional Chambers in which this technique is used. The sentences state the principle of the personality of the vote and relate it to the ius in officium, as well as pronounce on the nature of the suffrage of public representatives, extending the requirements of art. 79.3 of the Constitution beyond deputies and senators. This paper presents a systematization of the resolutions, explains their context and content, and also adresses some of their weak points in line with the concurrent particular vote from a perspective that considers the principle of loyalty to the system and the role of the individual members of the Chambers as inexcusable bases for any flexible interpretation of the basic norms of parliamentary law.
