Summary: The category of legitimate interest has been questioned in recent years, after the apparent consensus that existed on its definition was broken. This work suggests a concept of legitimate interest based on historical Law, which moves away from its opposition to the figure of subjective law, to focus on the differentiated operation of legitimate interest with respect to the pre-existing rights of citizens affected by administrative action.
