A complexidade argumentativa da tomada de decisão dos vetos no Poder Executivo Federal

The Brazilian President doesn´t decide alone. The Executive and Legislative branch are close because of the Brazilian Coalitional Presidentialism. It demands better presidential justifications when the President decides. This article explores the argumentative complexity of the Brazilian Executive Branch in the presidential decision of the veto. The paper uses a bibliographic review of Law and Political Science. It´s qualitative research about vetoes and arguments. The article aims to study the arguments brought to the Brazilian President during the production of law. The research seeks to answer two questions: how does the argumentative decision-making debate of presidential sanction and veto occur? Can the Argumentation Theory help in decision process of veto? In response, it demonstrates that there is no solipsistic presidential decision. It´s a complex decision-making process, based on merit and legal reasons. Legal arguments can help in the construction of such justifications and bring the branches together. The work seeks to offer a fertile field for future research using Argumentation Theory.

O presidencialismo de coalizão brasileiro aproxima o Legislativo do Executivo, o que demanda melhores justificativas presidenciais ao decidir. Este artigo explora a complexidade argumentativa do Poder Executivo federal na tomada de decisão presidencial do veto. A metodologia usada conjugar revisão bibliográfica do Direito e da Ciência Política, por meio de pesquisa qualitativa de natureza descritiva, sobre vetos e argumentação. O artigo almeja trazer para o debate os argumentos levados ao Presidente da República no momento de decisão do veto em projetos de leis aprovados pelo Congresso Nacional. A pesquisa busca responder duas perguntas: Como ocorre o debate argumentativo de tomada de decisão de sanção e veto presidencial? Os argumentos usados na tomada de decisão podem ser explorados pela argumentação jurídica? Como resposta, demonstra que inexiste uma decisão solipsista presidencial, mas sim um complexo processo decisório, pautado em razões de mérito e jurídicas. A argumentação jurídica pode ajudar na construção de tais justificativas e aproximar os Poderes. O trabalho busca oferecer um campo fértil para futuras pesquisas a serem desenvolvidas com o uso da argumentação jurídica.  Este artículo estudia la complejidad argumentativa del poder ejecutivo federal brasileño en la toma de decisiones de veto presidencial. Al combinar una revisión bibliográfica de Derecho y Ciencia Política, sobre vetos y argumentos, el artículo pretende traer al centro de las discusiones los argumentos llevados al Presidente de la República en el momento de la decisión de veto en proyectos de ley aprobados por el Congreso Nacional. La investigación busca dar respuesta a dos preguntas: ¿Cómo ocurre el debate argumentativo brasileño sobre la sanción presidencial y la toma de decisiones de veto? ¿Se pueden explorar los argumentos utilizados en la toma de decisiones mediante la argumentación jurídica? En respuesta, demuestra que no hay una decisión presidencial solipsista, sino un proceso de toma de decisiones complejo, basado en el mérito y razones legales.
