Our intention is to demonstrate that the so-called instrumentalrelationship with political pretensions with which her proposal has been criticized, is based on the ignorance of the aesthetic nature of the type of literature (realism) that the philosopher studies. For this, an analysis of literary realism is carried out to understand the socio-political condition of this literary movement and thus the political nature of Nussbaum’s bet.El punto de partida es la afirmación de que la narratividad es una forma de investigar los problemas sociales que se interesa por los significados a través de los cuales los involucrados describen su experiencia. Desde este paradigma, se discute la relación entre derecho y literatura, privilegiando la propuesta de Martha Nussbaum, debido a su potencia ético-política. Se quiere demostrar que la pretendida relación instrumental con pretensiones políticas con que se ha criticado su propuesta se sustenta en el desconocimiento de la naturaleza estética del tipo de literatura (el realismo) que estudia la filósofa.
