Education has been recognized throughout the world as a universal right, and as such, it must be guaranteed by each state. In higher education, the gap in access and treatment of the diversity of the student population is still very marked. Ecuador does not escape this reality, the diversity in its population has raised the bar in the extinction of exclusion mech-anisms in the educational area. The objective of this review is to summarize what is related to discrimination in Ecuadorian higher education, especially third level students. For which discrimination for reasons of gender, economic and national legislation will be developed in favor of free discrimination to students of higher education. The research was carried out under a bibliographic documentary type methodology, under the review modality. The review shows that Ecuador is a country with marked inequality in access and discriminatory treatment of higher education students, especially for gender and economic reasons. However, great achievements have been made in terms of legislation and programs that offer new forms of management that allow or guarantee equality and non-discrimination of the different groups that try to access and remain in these institutions. One of these radical changes for the third level of higher education is the admission process to public and private universities in the country for this year, which will no longer be carried out through national tests as in previous years, but instead now each educational institution will have its own admission process. It remains for the state to monitor that all this procedure is framed in transparency, efficiency and ethics, therefore, that the criteria of equality and non-discrimination are met. Likewise, it is expected that the legal instruments not only remain on paper, but that they are complied with in favor of educational inclusion and against discrimination.

En la educación superior, la brecha en el acceso y trato hacia la diversidad de la población estudiantil, aún sigue siendo muy marcada. Ecuador no escapa de esta realidad, la diversidad en su población ha subido la barra en la extinción de mecanismos de exclusión en el área educativa. El objetivo de la presente revisión consiste en compendiar lo relacionado a la discriminación en la educación superior ecuatoriana, especialmente a los estudiantes de tercer nivel. Para lo cual se desarrollará la discriminación por razones de género, económicas y la legislación nacional en pro de la libre discriminación a los estudiantes de la educación superior. La investigación se realizó bajo una metodología de tipo documental bibliográfica, bajo la modalidad de revisión. De la revisión se desprende que Ecuador es un país con una desigualdad marcada en el acceso y el trato discriminatorio a los estudiantes de educación superior, especialmente por razones de género y económicas. No obstante, se han logrado grandes alcances en materia de legislación y programas que ofrecen nuevas formas de gestión que permitan o garanticen la igualdad y la no discriminación de los diferentes grupos que intentan acceder y permanecer en estas instituciones. Uno de estos cambios radicales para el tercer nivel de educación superior es el proceso de admisión a las universidades públicas y privadas del país para el presente año, el cual ya no se realizará a través de las pruebas nacionales como en los anteriores años, sino que ahora cada institución educativa tendrá su propio proceso de admisión. Quedando por parte del estado monitorear que todo ese procedimiento se enmarque en la transparencia, eficiencia y en la ética, por ende, que se cumplan con los criterios de igualdad y no discriminación.
