Sumario: This article presents a comparative analysis of the necessity of regulating Industrial Property Policies, specifically the protection of patents, utility models and industrial designs generated in Guatemalan universities. The hypothesis is centered on the need to have policies for the protection of Industrial Property within the university centers, since they fulfill a creative and innovative function. It also develops the fundamental role of Intellectual Property Policies, which protect both the ownership of inventors and the use of inventions. The article also analyzes policies that prestigious universities have adopted in different parts of the World such as the United States, Europe and Latin America, and the way in which they regulate and determine the management of Industrial Property in these institutions. It concludes by affirming that it is necessary for Guatemalan universities to have special provisions for the assignment of Industrial Property rights
