Ecuador is one of the Latin American countries with great wealth in terms of biodiversity, where a large number of protected areas dedicat-ed exclusively to conservation are protected. In view of these characteristics and commitment to nature, Ecuador is one of the pioneers in enshrining various innovations and singularities in the management of environmental issues in its Constitution and other legal instruments. The fundamental objective of this research is to summarize what is related to the Environmental Legislation in Ecuador, with emphasis on the Constitution, the Environmental Management Law and the Organic Code of the Environment. The research was carried out under a bibliographic documentary type methodology, under the review modality. From the review it is clear that Ecuador has a legal body that cre-ates a precedent in environmental matters, beginning with its constitutional regulations which is considered to have evolved with respect to the recognition of rights related to the environment, similar, at the same time, they have gone approving other secondary regulations at the level of laws, ministerial agreements and other guidelines that contribute to the generation of policies that protect nature from the State. In conclusion, Ecuadorian legislation over time has undergone great and positive changes in terms of environmental matters. Starting from the 2008 Constitution, which resulted in a paradigm shift in the conception of the environment, where the mere protection of it, based on the environment as an object of law, is surpassed by the consecration of the environment as a subject of law. In this sense, and since this evolution, at the same time a whole body of laws, ministerial agreements and other guidelines have been promulgated, which allow the necessary State policies to be generated for the protection and conservation of nature.

Dadas estas características e compromisso com a natureza, o Equador é um dos pioneiros na consagração de várias inovações e singularidades na gestão de questões ambientais na sua Constituição e outros instrumentos legais. O objectivo fundamental desta investigação é resumir o que está relacionado com a Legislação Ambiental no Equador, com ênfase na Constituição, na Lei de Gestão Ambiental e no Código Orgânico do Ambiente. A investigação foi realizada sob uma metodologia de tipo documentário bibliográfico, sob a modalidade de revisão. Da revisão resulta claro que o Equador tem um órgão jurídico que cria um precedente em matéria ambiental, a começar pela sua regulamentação constitucional que se considera ter evoluído no que diz respeito ao reconhecimento dos direitos relacionados com o ambiente, semelhante, ao mesmo tempo, foram aprovando outros regulamentos secundários a nível de leis, acordos ministeriais e outras directrizes que contribuem para a geração de políticas que prote-gem a natureza do Estado. Em conclusão, a legislação equatoriana sofreu ao longo do tempo grandes e positivas alterações em termos de questões ambientais. A partir da Constituição de 2008, que resultou numa mudança de paradigma na concepção do ambiente, onde a mera protecção do mesmo, baseada no ambiente como objecto de direito, é ultrapassada pela consagração do ambiente como sujeito de direito. Neste sentido, e desde esta evolução, ao mesmo tempo foi promulgado todo um conjunto de leis, acordos ministeriais e outras directrizes, que permitem gerar as políticas estatais necessárias para a protecção e conservação da natureza.Ecuador es uno de los países de Latinoamérica con una gran riqueza en lo que a biodiversidad se refiere, en donde se resguardan un gran número de áreas protegidas dedicados exclusivamente a la conservación. En vista de dichas características y compromiso con la naturaleza, el Ecuador es uno de los pioneros en consagrar diversas novedades y singularidades en el manejo de los temas ambientales en su Constitución y demás instrumentos legales. El objetivo fundamental de la presente investigación es compendiar lo relativo a la Legislación Ambiental en Ecuador, con énfasis en la Constitución, la Ley de Gestión Ambiental y el Código Orgánico del Ambiente. La investigación se realizó bajo una metodología de tipo documental bibliográfica, bajo la modalidad de revisión. De la revisión se desprende que Ecuador posee un cuerpo legal que crea precedente en materia ambiental, comenzando con su normativa constitucional la cual se considera que evolucionó respecto al reconocimiento de los derechos vinculados al medio ambiente, asimismo, a la par, se han ido aprobando otras normativas secundarias a nivel de leyes, acuerdos ministeriales y otras directrices que contribuyen a que desde el Estado se generen políticas que protejan la naturaleza. En conclusión, la legislación ecuatoriana a lo largo del tiempo ha sufrido grandes y positivos cambios en lo que a materia ambiental se refiere. Partiendo desde la Constitución de 2008 que generó un cambio de paradigma en la concepción del ambiente, en donde se supera la mera protección de ésta, basada en el ambiente como objeto de derecho, por la consagración del ambiente como sujeto de derecho.
