Presently, the right to drinking water access has been jurisdictionally recognized through a constitutional interpretation seeking to establish the primacy of the principles, the values, the constitutional goals and the mandates consigned in the international instruments. A significant step forward in the recognition of access to water as a right has been set by the Municipality of Medellín with the auspicious minimum vital drinking water program, which has become a good forecast for the referendum to be approved and thus consecrate the fundamental right to drinking waterEl derecho del agua aun no ha sido consagrado en la constitución política de Colombia y en la mayoría de las constituciones de América latina, como un derecho fundamental no obstante, hay disposiciones normativas, de carácter constitucional que le dan el fundamento jurídico, político y social para su respectiva positivización. Actualmente el derecho al agua ha sido reconocido en sede jurisdiccional, a través de una interpretación constitucional que busca establecer la primacía de los principios, los valores, los fines constitucionales y los mandatos consignados en los instrumentos internacionales.
