Summary: The opposition of local communities to extractive projects in Latin America has become an important trend in investment arbitration. Due to the decisions arbitral tribunals have made in these cases, this issue has been framed as a conflict between local communities and investment arbitration. The purpose of this paper is proposing some causes of this conflict. To do so, the text develops causes originating both from an anthropological reading of the conflict and certain characteristics of the investment protection system. In this way, it concludes that these tensions arise out of a difference of perspective between the actors and that recent trends in investment arbitration could set the tone to solve them.
