In this research we explore the legal reform projects on abortion presented between the years 1986-2020 in the Congress of the Nation of Argentina, what were the proposed regulatory models, the main legal foundations and judicial precedents, and we show the sociopolitical nuances of these proposals in Latin America. This work seeks to contribute to contemporary feminist productions of law. For this, our proposal is based on Carol Smart's feminist socio-legal perspective, and we understand legal discourse as an institutionalized place of power struggles. The methodological strategy of this work is the study of the content of textual documents.

Nesta pesquisa estudamos os projetos de reforma legal sobre aborto apresentados entre os anos 1986-2020 no Congresso da Nação de Argentina, que foram os modelos regulatórios propostos, os principiais fundamentos jurídicos e precedentes judiciais, e mostramos as nuances sociopolíticas dessas propostas. Este trabalho procura nutrir as produções feministas contemporâneas do direito. Para tanto, nossa proposta parte da perspectiva sociojurídica feminista de Carol Smart e entendemos o discurso jurídico como um lugar institucionalizado de lutas de poder. A estratégia metodológica desde trabalho é o estudo do conteúdo de documentos textuais.En esta investigación exploramos los proyectos de reforma legal sobre aborto presentados entre los años 1986 y 2020 en el Congreso de la Nación de Argentina, cuáles fueron los modelos regulatorios propuestos, los principales fundamentos jurídicos y precedentes judiciales, y mostramos los matices sociopolíticos de estas propuestas. Este trabajo busca aportar a las producciones feministas del derecho contemporáneas en América Latina. Para esto, nuestra propuesta parte de la perspectiva sociojurídica feminista de Carol Smart y entendemos el discurso jurídico como un lugar institucionalizado de luchas de poder.
