Sumario: The objective of this article is to analyze Indigenous Justice from the perspective of Human Rights, determine whether or not rights are violated, investigating, establishing and analyzing the application of justice and a possible impact on the fundamental rights established in the Magna Carta. of our country, to conceptualize what the indigenous peoples and the indigenous people themselves are that will serve to understand the in-vestigation, determine the procedure and the sanctions that can be issued by the corresponding communities or councils, which if it is respected that there is no cruel, inhumane treatment and torture since the indigenous communities or sectors are interpreting the constitutional norm in an absolutely wrong way, since the legal min-imums are not respected, which are the guarantees for all human beings. This research contains a qualitative approach, because it deals specifically with the study of legal facts that justify the problem.
