In search of real legal equality, the Convention on the Rights of Persons with Disabilities introduced for "all members of the human family" (Preamble) a notable advance within human rights, including dignity. With the interest that those postulates are fulfilled to the highest degree and do not become empty or meaningless statements, through this essay, some formal and practical deficits will become visible to formulate recommendations for the exercise of the full capacity legal.

Em busca de uma real igualdade jurídica, a Convenção sobre os Direitos das Pessoas com Deficiência introduziu para "todos os membros da família humana" (Preâmbulo), um notável avanço no plexo dos direitos humanos, incluindo a dignidade. Com o interesse de que esses postulados sejam cumpridos ao máximo, e não se tornem declarações vazias ou sem sentido, através deste ensaio se tornarão visíveis alguns déficits formais e práticos, no sentido de formular recomendações para o exercício da plena capacidade jurídica.Interdecir y permitir es una antinomia verbal con enorme distancia conceptual que recoge los extremos semánticos por los que ha transitado la humanidad, desde la prohibición o interdicción de la capacidad legal de las personas en situación de discapacidad hasta la permisión plena del ejercicio y goce de sus derechos. En búsqueda de real igualdad jurídica, la Convención sobre los Derechos de las Personas con Discapacidad introdujo, para “todos los miembros de la familia humana” (Preámbulo), un notable avance dentro de los derechos humanos, entre ellos el de la dignidad.
