Summary: This essay constitutes a diagnosis around the decision adopted by the Office of the Prosecutor of the International Criminal Court to close the most extensive preliminary examination in its history. Thus, it presents considerations about the criminal policy of this Office and the repercussions and expectations of such determination according to the Colombian context. To do this, part by characterizing the preliminary examination advanced by 17 years; then, assess the incidence of its closure; and finally, it studies the current conditions of the human rights situation in Colombia and the institutional capacity to face up to the role of the Court's Prosecutor's Office. In this way, it identifies the following reflections: (i) the need to define the stages of the preliminary examinations; (ii) that the decision to close the preliminary examination in Colombia had (and will have) more political than practical effects by the positive complementarity; and (iii) the crimes committed after the signing of the Final Peace Agreement between the Colombian government and the Revolutionary Armed Forces of Colombia – People's Army (FARC-EP) constitute a latent concern from the purposes that the Rome Statute seeks.
