Summary: In contrast to individual legitime or reserved share systems, in which the forced participation in the legitime covers the hypothetical situation of the beneficiary being left in need upon the death of the deceased, in collective or symbolic reserved share systems, in which the beneficiary only has an expectation until the opening of the succession, as they can be excluded without cause and, thus, not receive any part of the estate, the duty of care of the de cuius is safeguarded by a right to receive maintenance from the estate. Does this open the way towards a succession system of forced maintenance?
