The possibilities of complying with the measures to control the circulation of COVID-19 had a differential impact between the different social sectors, increasing pre-existing inequalities. Recent data has shown that one of the most strongly affected populations were the inmates of the penitentiary system, whose work, educational and recreational activities were further restricted. Regarding their situation, the restrictions on access to prison visits not only implied greater difficulties in establishing contact with their loved ones, but also a decrease in access to basic goods. Although Uruguay was characterized by the relatively late appearance of COVID in prisons, the restrictive measures strongly affected life in prison since the beginning of the pandemic. On the other hand, once the first cases appeared, the spread of the virus was extremely rapid. In this context, the difficulties suffered by the prison population were altered (both in type and magnitude) in relation to those previously faced. The objective of this article is to analyze the changes and continuities in the levels of violation of human rights within Uruguayan prisons, by comparing data corresponding to the months of January-April 2019 in contrast to the same period in 2021. This comparative analysis is based on the register of submissions and complaints (“Registro de Planteos y Denuncias”) developed by the “Oficina del Comisionado Parlamentario para el Sistema Penitenciario”. In order to comprehensively portray the prison situation during these periods, both quantitative methodologies (bivariate descriptive analysis) and qualitative methodologies (speech analysis of complaints) are combined.

Datos recientes demuestran que una de las poblaciones más fuertemente afectadas fueron las personas privadas de libertad, que vieron aún más restringidas sus actividades laborales, educativas y recreativas. Por su parte, las restricciones en el acceso a las visitas no sólo implicaron mayores dificultades para establecer contacto con sus seres queridos, sino también una disminución en el acceso a bienes elementales. Si bien Uruguay se caracterizó por la aparición relativamente tardía del COVID en cárceles, las medidas restrictivas afectaron fuertemente desde el inicio de la pandemia al régimen de vida en el encierro. Por otro lado, una vez que aparecieron los primeros casos, la expansión del virus fue extremadamente rápida. En este contexto, las problemáticas sufridas por la población reclusa se vieron alteradas (tanto en el tipo, como en la magnitud) en relación a las enfrentadas previamente. El objetivo de este artículo consiste en analizar los cambios y continuidades en los niveles de vulneración de derechos dentro de las prisiones en Uruguay comparando datos correspondientes a los meses de enero-abril de 2019 en contraste con el mismo período del año 2021. Este análisis comparativo se sustenta sobre el Registro de Planteos y Denuncias elaborado por la Oficina del Comisionado Parlamentario para el Sistema Penitenciario.
