Summary: The patrimonial liability of the State is a subject belonging to the general part of administrative law. In Peruvian law, this institution doesn’t have a clear and deep theoretical development as the civil liability system applied in private law does. Through the present work, the author outlines some generic considerations on the foundations of the duty to compensate in charge of the Public Administration when in the exercise of its public functions it causes injuries in the administered ones, so that from them an autonomous theory can be built, without prejudice to resorting to the rules of private law via analogy
