Summary: The article analyzes the relevance of preventive detention as a precau-tionary measure in criminal proceedings against indigenous people in Ecuador, to whom collective rights established in the Constitution and in international human rights treaties apply.Inter-American jurisprudence has developed standards on preventive detention, which will be analyzed within the framework of cultural diversity, considering its precautionary nature and seeking to establish certain lines for an intercultural interpretation, where indigenous authorities can participate in the precautionary guarantees.The Constitutional Court of Ecuador has several Judgments, in which it establishes intercultural lines for cases and judicial processes against individuals of indigenous peoples and nationalities.
