On January 26, the Chamber for the Recognition of Truth and Responsibility of the Colombian Special Jurisdiction for Peace issued the Decision number 19 of 2021. There, the Chamber used the figure of indirect coperpetration by virtue of an organized power apparatus to establish the responsibility of the members of the secretariat of the extinct farc for the de-privations of liberty executed directly by other members of that organization. The following reflections aim, in the first place, to subject the position adop-ted by the Chamber to a critical analysis. Then, it will outline and put into practice a system for the graduation of criminal participation that allows in a more precise and materially fairer way to establish the degrees of criminal participation of the farc members who took part in those events. |
