Summary: The purpose of this brief paper is to present the initial questions on privately owned urban subsoil. Mainly to recognize its lack of legal concreteness and impossibility of a correct development as part of the urban property that does not adapt to the delimitations of the current social function of article 70 of the Peruvian Constitution. In order to arrive at these considerations, an attempt is made to show with criticism the lack of development of essential legal concepts, such as city, urban territory, urban cycles, rationalization interest theory; elements that would allow overcoming the current monopoly of the building regime, an ordinance that exists and is the only thing that is studied with emphasis in Peruvian law.
