Summary: After describing the legal framework of reference for the regulation of beach concessions, the contribution dwells on the main enforcement issues and the ineffectiveness of the current provisions. The critical elements that the national discipline has presented in its application since the intervention of the CJEU ruling of 14 July 2016 (Promoimpresa case) are then examined in depth. Finally, some reflections are developed on the prospects of future development that are being outlined for the reform of the system of maritime domain concessions for tourism and recreational purposes, also in light of the policies related to the recovery and resilience mechanism connected to the EU Next Generation.
