Summary: The absence of a general theory of public goods in Colombian law hinders the construction of general rules applicable to public concessions. Given the inadequacy of the concession contract of Law 80 of 1993, new options arise as a result of recent regulatory reforms, in which the creation of special contracts to manage the local public domain is allowed and local authorities are given the power to regulate. This article aims to analyze the difficulties generated by the absence of a regime focused on the management of public assets and proposes a reading of the legal system in line with the social and economic valorization of these assets.
