The USA is the pioneer in the implementation of mitigation banks, first with Wetland mitigation banking and a few years later with Conservation banking. Although they refer to different fields, both modalities have in common the search for no net loss of biodiversity, involving the market for this purpose, when the development of plans or projects requires the generation of permanent environmental damage. Their regulation has evolved to the point of establishing the preference of this form of compensation over the other two possible methods: In-Lieu Fee Mitigation and Permittee-Responsible Mitigation. This paper analyses the origins and evolution of these forms of environmental compensation. |
