Summary: Mitigation banking are a tool used in various countries as a way of compensating for the permanent negative impacts produced by the implementation of plans and projects. Their use in Spain has been anecdotal, through three pilot projects. This scarce implementation may be caused by the absence of an adequate regulatory framework that provides legal certainty on some of its essential elements such as the term of the obligations, the requirements demanded of the owners of the banks or the valuation of the initial state of conservation and the generation of environmental credits. This paper analyses all these aspects of the Spanish pilot experiences, with the intention of shedding light on their functioning and pointing out some points for improvement.
