Then, a qualitative study was conducted with the objective of analyzing compliance with the legal requirements for the creation and implementation of the PEMP. The data comes from documental analysis, interviews and participant observation with the Management Council from 2016 to 2017. It was identified that the environmental agency fulfilled the requirements for the institution of the Conservation Unit (CU), but the speed impaired the result; Relevant advances in the implementation of the CU were due to a judicial decision and due to the ethical commitment of the Management Council, especially the UC manager. The lack of efficiency in complying with the legal requirements for the UC institution entail complex obstacles to its implementation.O Parque Estadual Mata da Pipa (PEMP), área protegida criada há mais de 10 anos (Decreto Estadual nº 19.341, de 12 de setembro de 2006), ainda não foi implementado. Então, realizou-se estudo de natureza qualitativa com objetivo de analisar o cumprimento dos requisitos legais para criação e implementação do PEMP. Os dados provem de análise documental, entrevistas e observação participante junto ao Conselho Gestor de 2016 a 2017. Identificou-se que o órgão ambiental cumpriu os requisitos para a instituição da Unidade de Conservação (UC), mas a celeridade comprometeu o resultado; Relevantes avanços na implantação da UC ocorreram por força de decisão judicial e por comprometimento ético do Conselho Gestor, em especial da gestora da UC.
