This article begins with the mention to the concept of “crimmigration”. This notion describes the increasing relationship between migration law and criminal law. The governmental authorities consider that detention can be a useful tool to control the irregular entry and stay in their countries. Moreover, International Human Rights Law allows the detention of migrant to prevent unauthorized entry or to effect deportation. However, from the European perspective, the European Convention on Human Rights has established two limits to the detention: the right to liberty (article 5) and the prohibition of torture or to inhuman or degrading treatment or punishment (article 3). This article provides an overview of the jurisprudence of the European Court of Human Rights regarding both articles, taking into consideration the situation of migrant children in particular.

La detención de inmigrantes en situación irregular para evitar su entrada en el territorio de un Estado o para garantizar su expulsión del mismo se ha convertido en una práctica habitual en toda Europa. Esta práctica podría estar priorizando excesivamente el objetivo estatal de control migratorio, especialmente respecto de la denominada «migración irregular», en detrimento del cumplimiento de obligaciones derivadas del derecho internacional de los derechos humanos. A pesar de que el derecho internacional de los derechos humanos admite la llamada detención administrativa de los inmigrantes en situación irregular, impone ciertas condiciones. El Convenio Europeo de Derechos Humanos ha permitido articular esas condiciones utilizando dos ejes de referencia: el derecho a la libertad, garantizado en el artículo 5; y el derecho a la integridad de la persona, deducido de la prohibición de malos tratos impuesta en el artículo 3. A su vez, el Tribunal Europeo de Derechos Humanos, artífice de la construcción de esos límites a la detención, ha incluido en su jurisprudencia una variada referencia a la situación particular de los niños migrantes detenidos, tanto cuando llegan solos como acompañados de sus familias.
