The judge is the subject called to find a space where the right and the justice can reconcile or to reconcile. From this character depends that the right is a balance instrument, of justice or that it finishes being only norm product of the necessities of a minuscule group that holds the power. This writing seeks to present an optimistic vision of the right where the paper of the jurisdiction goes beyond the single legality.La función de ejercer jurisdicción es quizá la parte más excelsa del Derecho. Decir el derecho en una situación conflictiva determinada no es un ejercicio simplista y que pueda desarrollarse sin ningún miramiento de las necesidades sociales que se exponen en un contexto explícito. El juez es el sujeto llamado a encontrar un espacio donde el derecho y la justicia puedan conciliarse o reconciliarse. De este personaje depende que el derecho sea un instrumento de equilibrio, de justicia o que termine siendo sólo norma, producto de las necesidades de un grupo minúsculo que detenta el poder.
