Summary: It is paradoxical that the pactum de retrovendendo (used over the centuries as a credit guarantee) has not been widely discussed in the Roman sources, despite the fact that a mortgage system as solid as the modern one did not exist in Rome. Starting from this apparent contradiction, this paper aims to address the scope and effects of the pactum de retrovendendo with the target of explaining the causes of its limited use in Rome.
