These conditions are part of the “essential content” of social rights, which are located at the same normative level as fundamental freedoms and political rights. In this article we try to demonstrate that social rights are authentic fundamental rights that are guaranteed in international treaties, as well as in the constitutional text. Social rights have a structure common to the “classic” freedoms and political rights because both categories impose positive and negative obligations that recognize a legal position in favor of people.La constitucionalización del contenido originario de socialización, que es inherente a la cláusula del Estado social y democrático de derecho, supone reconocer un conjunto de condiciones existenciales mínimas que constituyen precondiciones necesarias para establecer y conservar una democracia constitucional. Estas condiciones forman parte del «contenido esencial» de los derechos sociales, los cuales están ubicados al mismo nivel normativo que las libertades fundamentales y que los derechos políticos dentro de esta fórmula constitucional. En este trabajo procuramos demostrar que los derechos sociales son auténticos derechos fundamentales que están garantizados en los tratados, pactos y convenciones internacionales, así como en las normas iusfundamentales que conforman el texto constitucional.
