It also studies the relationship between the precautionary principle and the proportionality principle, outlining the importance of the ex ante and the ex post evaluations in a scenario in which the scientific uncertainty that determines the application of the precautionary principle modulates the suitably test and the proportionality principle restrict the discretion of the regulatory bodies selecting the measures that could elude some risk.En una sociedad del riesgo como la actual, el principio de precaución constituye una pieza fundamental del proceso de toma de decisiones. Medidas como la inclusión de las poblaciones de lobo ibérico situadas al norte del Duero en el Listado de Especies Silvestres en Régimen de Protección Especial dan buena cuenta de ello. El presente trabajo expone la configuración normativa y jurisprudencial del principio de cautela a nivel internacional, regional europeo y nacional; y estudia su relación con el principio de proporcionalidad, destacando la necesidad de reforzarlas evaluaciones ex ante y ex post de las normas jurídicas en un contexto en el que la incertidumbre científica que sirve de presupuesto a la aplicación del principio de precaución matiza el test de idoneidad que resulta inherente al principio de proporcionalidad y este, a su vez, limita la discrecionalidad que el regulador posee al seleccionar las medidas restrictivas que, en abstracto, cabría adoptar para evitar el riesgo que hadeterminado la entrada en escena del principio de cautela.2022text (article)application/pdfhttps://dialnet.unirioja.es/servlet/oaiart?codigo=8557035(Revista) ISSN 0034-7639Revista de administración pública, ISSN 0034-7639, Nº 218, 2022, pags. 235-262spaLICENCIA DE USO: Los documentos a texto completo incluidos en Dialnet son de acceso libre y propiedad de sus autores y/o editores.
