Summary: More and more studies are trying to tackle hate crime from very different perspectives: criminal law; constitutional right; comparative law; criminology. However, till the date no explanation has been made to the possible concomitance between the number of foreign population and its possible direct relationship with hate crimes committed by racism or xenophobia in Spain. To verify this point, the official data published by the National Statistics Institute and the data provided by the Secretary of State for Security of the Home Office, in the period between 2014 and 2018, have been analyzed. The results obtained show that there is not always a direct relationship between immigration and xenophobia, but it seems that other types of social, economic and/or cultural factors, could have relevance in this circumstance.
