The following research focuses on nature as a subject of special protection in Colombia. The objective is to determine the importance of the environment in the existence and subsistence of human beings, in addition to distinguishing the main problems faced by Colombia in environmental matters. Likewise, through the application of comparative law, other Constitutions that protect the environment and consider nature as a subject of rights are analyzed. However, among the most debated issues during the post-pandemic period is the approval by the national government of projects such as the allocation of pilot tests for fracking and the issuance of environmental licenses for mining exploitation. The aim is to analyze the scope of these governmental decisions from a constitutional and human rights perspective, as well as to contrast the supposed economic benefits that this practice generates for the country, especially as a "strategy" of the Government to solve the economic crisis resulting from the covid-19 pandemic and the transgression of constitutional principles such as precaution, prevention, progressivity and non-regressivity, and risk prevention.

O objetivo é determinar a importância do meio ambiente na existência e subsistência dos seres humanos, assim como distinguir os principais problemas que a Colômbia enfrenta em matéria ambiental. Da mesma forma, através da aplicação do direito comparado, outras Constituições que protegem o meio ambiente e consideram a natureza como um sujeito de direitos são analisadas. Entretanto, entre as questões mais debatidas durante o período pós-pandêmico está a aprovação pelo Governo nacional de projetos como a alocação de testes piloto para fracionamento e a emissão de licenças ambientais para exploração mineira. O objetivo é analisar o alcance dessas decisões governamentais sob uma perspectiva constitucional e de direitos humanos, bem como contrastar os supostos benefícios econômicos que essa prática gera para o país, especialmente como uma “estratégia” do Governo para resolver a crise econômica resultante da pandemia de covid-19 e a transgressão de princípios constitucionais como a precaução, a prevenção, a progressividade e a não-regressividade e a prevenção de riscos.La siguiente investigación tiene como eje central a la naturaleza como sujeto de especial protección en Colombia. El objetivo es determinar la importancia que tiene el medio ambiente en la existencia y subsistencia del ser humano, además de distinguir los principales problemas a los que se enfrenta Colombia en materia ambiental. Así mismo, a través de la aplicación del derecho comparado se analizan otras Constituciones que protegen el medio ambiente y consideran la naturaleza como sujeto de derechos. No obstante, entre los temas más debatidos durante la pospandemia se encuentra la aprobación que hizo el Gobierno nacional de proyectos como la asignación de pruebas piloto de fracking y la expedición de licencias ambientales para la explotación minera.
