This work demonstrates that the licit flexibility of theprinciple of legality derives from the corporate-representative constitution of schools.Consequently, collegiate sanctions cannot be identified with disciplinary sanctions ofthe personnel. After certain doubts, the Constitutional court states with good criteriathe compatibility of both, derived from the diversity of juridical goods protected.A pesar de las discusiones doctrinales, del ordenamiento peruano se deduce indudablementeque los Colegios profesionales son Administraciones públicas.La relación jurídica entre colegiados y Colegio se viene calificando, en la jurisprudenciaespañola, como “relación especial de sujeción”, típicamente “doméstica”, categoríautilizada tradicionalmente para justificar limitaciones de derechos; sin embargo, elTribunal Constitucional peruano no asume esta doctrina. En el trabajo se demuestraque la lícita flexibilización del principio de legalidad en estas relaciones deriva de laconstitución corporativo-representativa de los colegios.En consecuencia, las sanciones colegiales no se pueden identificar con las sancionesdisciplinarias de personal.
