That has perhaps been its main purpose: to rationally explain what a crime is and why the State has the legitimacy to impose a penalty on whoever committed it. Within the framework of this dogmatic necessity, the concept of action had, and continues to have, in a wide sector of doctrine, a preponderant role. However, the outlook has changed, today we face a risky, contingente society in constant and vertiginous advance, for this reason many of the once transcendental theoretical paradigms, have been re-evaluated. In the light of current sociological developments, the action is not relevant by itself, but by its criminal sense, by the communication it transmits. The crime, then, must be established from what a fact means for the criminal law system and for the normative structure of society, not from the act itself considered or from the intention of the agent when it was carried out.A lo largo de su existencia, la ciencia penal ha intentado construir una estructura sistemática en torno al delito y los elementos que lo componen. Esa ha sido quizás su principal finalidad: explicar racionalmente qué es un delito y por qué el Estado tiene la legitimidad para imponer una pena a quien lo ha cometido. En el marco de esa necesidad dogmática, el concepto de acción tuvo, y sigue desempeñando, en un amplio sector de la doctrina, un papel preponderante. Empero, el panorama ha cambiado, hoy en día nos enfrentamos a una sociedad riesgosa, contingente, en constante y vertiginoso avance, por este motivo muchos de los paradigmas teóricos otrora trascendentales, se han visto revaluados. A la luz de los desarrollos sociológicos actuales, la acción no es relevante por sí misma, sino por su sentido delictivo, por la comunicación que transmite.
