We uphold the idea that the access to justice must be understood as an essential human right in a democratic state. So, it is relevant to remove obstacles affecting these categories of people in line with the international human rights standards. In this context, based on the Chilean case, we endorse the idea that, within the jurisdictional function, the gender perspective contributes to a more effective protection of rights.Este trabajo tiene por objetivo defender la incorporación de la perspectiva de género como una estrategia que favorece el logro de la tutela judicial efectiva para mujeres y personas LGBTIQ+. Afirmamos que el acceso a la justicia debe ser comprendido como un derecho humano indispensable en un Estado democrático, debiendo cuidar la remoción de los obstáculos que afectan especialmente a estas categorías de personas, como lo han indicado estándares internacionales de derechos humanos.
