Reconfiguración teórica y normativa de las limitaciones al derecho de autor en favor de bibliotecas en el entorno digital

Library activity in digital environments affects the patrimonial faculties of authors whose works are collected in these institutions, hence the need to find a fair balance between both interests. The objective of this research is to establish the theoretical and normative assumptions that must protect the adaptation of the system of limits and limitations to copyright in favor of libraries in the current digital environment, in a way that contributes to the reduction of the effects on authors or copyright holders and restore the balance that must exist between the right of access to culture and the right of creators. The results are specified in the contribution of the theoretical and normative assumptions necessary for the establishment of a system of limits and limitations in favor of libraries in the digital environment and in obtaining a bibliographic material to be used as a source of study and consultation, both in the undergraduate and postgraduate academic field, whether by lawyers, librarians, authors, and / or administrative personnel who are in charge of the matter.

O objectivo desta investigação é estabelecer os pressupostos teóricos e regulamentares que devem sustentar a adaptação do sistema de limites e limitações aos direitos de autor a favor das bibliotecas no ambiente digital actual, de modo a contribuir para reduzir o impacto sobre os autores ou titulares de direitos de autor e restabelecer o equilíbrio que deve existir entre o direito de acesso à cultura e os direitos dos criadores. Os resultados são materializados na contribuição dos pressupostos teóricos e normativos necessários para o estabelecimento de um sistema de limites e limitações em favor das bibliotecas no ambiente digital e na obtenção de material bibliográfico a ser utilizado como fonte de estudo e consulta, tanto na área académica de graduação como de pós-graduação, quer por juristas, bibliotecários, autores e/ou pessoal administrativo responsável pelo assunto.La actividad bibliotecaria en entornos digitales incide en facultades patrimoniales de autores cuyas obras se coleccionan en estas instituciones, de ahí la necesidad de encontrar un justo equilibrio entre ambos intereses. Constituye objetivo de la presente investigación fundamentar los presupuestos teóricos y normativos que deben amparar la adecuación del sistema de límites y limitaciones al derecho de autor en favor de bibliotecas en el entorno digital actual, de manera que contribuya a la reducción de las afectaciones a los autores o titulares del derecho de autor y restablezca el equilibrio que debe existir entre el derecho de acceso a la cultura y el derecho de los creadores.
