Discursive hegemony has made it impossible for indigenous people to express themselves in their own terms; however, in the unfinished exercise of the disputes for the power to speak, they have been conditioned to enter the struggles of the legal field that, even imposing rules beyond their own control. Cultural, political and legal practices constitute a strategy for the expansion and guarantees of their human rights. In this article, we present part of the results of the critical analysis of the discourse of the judgments of the Colombian Constitutional Court, which ruled in favor of the prior, free and informed consultation, specifically the analysis of the discursive behavior of the statement “ancestral territory”. The disputes over the power to speak, of indigenous people and a Court with a rights approach, have gradually sought to permeate the harsh discourses of the legal field with ancestralism. However, although the Court decided to grant the protection of the right to prior consultation, in the follow-up of the cases, it was found that the consultations were not carried out and, for the most part, there was a deepening of the problems that were being resolved; because the causes of territorial conflict remain intact.

Neste artigo, apresentamos uma parte dos resultados da análise crítica do discurso das sentenças do Supremo Tribunal Federal da Colômbia, que decidiu a favor da Consulta Prévia, livre e informada, especificamente a análise do comportamento discursivo do enunciado “Território ancestral”. As disputas pelo poder dizer dos povos indígenas e o Supremo Tribunal Federal com abordagem legal, têm procurado, gradualmente, permear de ancestralidade os ásperos discursos do campo jurídico. Porém, ainda que o Supremo Tribunal Federal decidiu outorgar o amparo do direito de consulta prévia, no seguimento dos casos, foi detectado que as consultas não foram realizadas, e que na maioria delas, houve um aprofundamento das problemáticas que se pretendia resolver; motivo pelo qual as causas do conflito territorial permanecem intactas.La hegemonía discursiva ha imposibilitado a los pueblos indígenas expresarse en sus propios términos, sin embargo, en el ejercicio inacabado de las disputas por el poder decir, se han visto condicionados a entrar en las luchas del campo jurídico que, aun imponiendo reglas ajenas a sus prácticas culturales, políticas y del derecho propio, se constituyen en una estrategia para la ampliación y garantías de sus derechos humanos. En este artículo, se presenta parte de los resultados del análisis crítico del discurso de las sentencias de la Corte Constitucional colombiana, que fallaron a favor de la Consulta Previa, libre e informada, específicamente el análisis del comportamiento discursivo del enunciado “territorio ancestral”. Las disputas por el poder decir, de los pueblos indígenas y una Corte con enfoque de derechos, han procurado, paulatinamente, permear de ancestralidad los discursos duros del campo jurídico.
